End User License Agreement

This End User License Agreement (“EULA”) governs access to and use of software, applications, hosted services and documentation provided by Bitkosh Technologies Private Limited (“Bitkosh”, “we”, “us” or “our”). By installing, accessing or using an applicable service, you agree to this EULA and the applicable order form or service terms.

Subject to payment, authorization and compliance with this EULA, Bitkosh grants you a limited, non-exclusive, non-transferable and revocable right to use the software during the applicable term, solely for internal business purposes and within the usage limits stated in the order form.

You must not copy, resell, sublicense, lease, distribute or make the software available to unauthorized users; reverse engineer or attempt to discover source code except where permitted by law; bypass access controls or security features; or use the service for unlawful, harmful, fraudulent or infringing activity.

You are responsible for accurate account information, protecting credentials and ensuring users access the service only for authorized purposes. You remain responsible for activity performed through your accounts, except to the extent caused by Bitkosh’s breach of applicable obligations.

You retain ownership of data and content submitted to the service. You grant Bitkosh the limited rights needed to host, process, transmit, secure and support that content. Where Bitkosh processes personal data on your behalf, the applicable Data Processing Agreement governs that processing.

Bitkosh and its licensors retain all rights in the software, service, documentation, designs, trademarks and underlying technology. Except for the license expressly granted here, no rights are transferred to you. Feedback may be used to improve Bitkosh products without transferring ownership of confidential information.

Bitkosh maintains reasonable administrative, technical and organizational safeguards appropriate to the service. Availability, support levels, maintenance windows and recovery commitments are governed by the applicable order form or service-level terms.

Fees and payment terms are stated in the applicable order form. Bitkosh may suspend access when reasonably necessary to protect the service, address security risk, comply with law or respond to overdue undisputed fees. On termination, the license ends and the parties follow applicable data return, deletion and transition requirements.

Bitkosh will provide the service with reasonable care and skill. Except as expressly stated in the applicable agreement, the service is provided to the extent permitted by law without implied warranties. Liability, exclusions, caps and indemnity obligations are governed by the applicable order form and negotiated commercial terms.

This EULA, together with applicable order forms and referenced policies, forms the agreement for the service. If there is a conflict, the order form controls for its specific commercial terms. Neither party may assign the agreement except as permitted by its terms. Force majeure events outside reasonable control are excused for the affected period.
